1. Introduction

These Terms and Conditions ("Terms") govern your use of the services provided by Bored Mining Ltd ("Company", "we", "us", or "our"), including our mining hosting services and the Bored Mining mobile application ("App"). By accessing or using our services, you agree to be bound by these Terms.

2. Service Description

Bored Mining provides professional cryptocurrency mining hosting services, including:

• Mining Hosting: Secure facility hosting for your mining hardware with power, cooling, and network infrastructure.
• Monitoring: Real-time monitoring of hashrate, miner health, and operational status via our App.
• Earnings Tracking: Dashboard for tracking BTC, LTC, DOGE, and other cryptocurrency payouts.
• Alerts: Push notifications for hardware issues, performance changes, and payout events.

3. Eligibility

To use our services, you must:

• Be at least 18 years of age.
• Provide valid government-issued identification upon request.
• Provide accurate and complete registration information.
• Not be located in a jurisdiction where cryptocurrency mining or our services are prohibited.
• Comply with all applicable laws and regulations, including anti-money laundering (AML) and know-your-customer (KYC) requirements.

4. Account Registration

You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account. You must notify us immediately of any unauthorized use at terms@bored-mining.com.

5. Payment Terms

• Hosting fees are billed monthly in advance as specified in your service agreement.
• Payments may be made in AED, USD, or cryptocurrency as agreed.
• Late payments may incur a fee of 1.5% per month on outstanding balances.
• We reserve the right to suspend services for accounts with overdue payments exceeding 14 days.
• Mining payouts are distributed according to the payout schedule specified in your service agreement, subject to minimum payout thresholds.
• All fees are exclusive of applicable taxes, which are your responsibility.

6. Hardware & Equipment

• You retain ownership of any mining hardware you ship to our facility.
• We are responsible for providing power, cooling, network connectivity, and physical security.
• We are not liable for hardware failures, manufacturer defects, or normal wear and tear.
• Removal of equipment requires 30 days written notice.

7. Service Level

We target 99.5% uptime for our hosting infrastructure. Planned maintenance windows will be communicated at least 48 hours in advance. We do not guarantee specific mining returns, hashrate levels, or cryptocurrency prices.

8. Prohibited Activities

You agree not to:

• Use our services for any unlawful purpose.
• Attempt to gain unauthorized access to our systems or other users' accounts.
• Interfere with the operation of our infrastructure or other users' equipment.
• Reverse-engineer, decompile, or disassemble the App.
• Use the App to transmit malicious software or harmful content.

9. Limitation of Liability

To the maximum extent permitted by law:

• Our total liability shall not exceed the fees paid by you in the 12 months preceding the claim.
• We are not liable for indirect, incidental, special, consequential, or punitive damages.
• We are not liable for losses arising from cryptocurrency price fluctuations, network difficulty changes, or blockchain protocol modifications.
• We are not liable for losses caused by force majeure events including but not limited to natural disasters, power grid failures, government actions, or internet outages.

10. Indemnification

You agree to indemnify and hold harmless Bored Mining Ltd, its directors, officers, and employees from any claims, damages, or expenses arising from your use of our services or violation of these Terms.

11. Intellectual Property

The App, its content, features, and functionality are owned by Bored Mining Ltd and are protected by copyright, trademark, and other intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to use the App for its intended purpose.

12. Termination

• Either party may terminate the service agreement with 30 days written notice.
• We may terminate or suspend your account immediately for breach of these Terms.
• Upon termination, you must arrange collection of your equipment within 60 days. After this period, storage fees may apply.

13. Modifications

We reserve the right to modify these Terms at any time. Material changes will be communicated via the App or email at least 14 days before taking effect. Continued use of our services constitutes acceptance of modified Terms.

14. Governing Law & Jurisdiction

These Terms are governed by the laws of the United Arab Emirates. Any disputes shall be subject to the exclusive jurisdiction of the courts of Ras Al Khaimah, UAE. The parties agree to attempt resolution through good-faith negotiation before initiating legal proceedings.

15. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions shall continue in full force and effect.
